Terms of Service

1. Acceptance of Terms
By accessing or using CavaIt ("the Service"), operated by CavaIt Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
CavaIt is a platform that lets a business store its business credentials, such as proof of insurance, licences, and certifications, in one profile and share them through a single link. Businesses can also request credentials from other businesses. The Service hosts and displays the documents and information that businesses provide. It does not sell, provide, broker, or advise on insurance or any other credential.
3. Not an Insurer, Broker, or Advisor
CavaIt is not an insurance company, broker, agent, or adviser, and does not provide insurance, legal, or professional advice. We host and display proof that businesses upload about themselves. We do not underwrite coverage, guarantee that any policy is in force, or confirm coverage with any insurer unless a feature expressly states that a carrier or broker confirmation has taken place. You should not treat a CavaIt profile as a substitute for confirming coverage or credentials directly with the relevant insurer, issuer, or authority.
4. What "Verified" Means
Where the Service labels information as checked or verified, that label describes only the specific check we performed, which is stated on the profile. At the current stage, a check confirms that a document was provided and that its stated dates are current. It does not confirm with the insurer or issuer that the underlying policy or credential is genuine or in force, unless the profile expressly says a broker or carrier confirmation was made. We are not responsible for documents that are altered, forged, expired, or misrepresented by the business that provided them.
5. User Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate and complete information and keep it current. You must be at least 18 years of age and authorized to act on behalf of the business you register.
6. Your Content and Responsibility
You are solely responsible for the documents and information you upload, and you represent that you have the right to upload and share them and that they are accurate and current. You must not upload documents that belong to another business without authority, that contain another person's personal information without a lawful basis, or that are false or misleading. We may remove content, suspend a profile, or revoke a verification status if we believe in good faith that content is inaccurate, fraudulent, or in breach of these Terms.
7. Requests and Reliance Between Businesses
When you request credentials from another business, or respond to a request, you are responsible for how you use the information you receive. CavaIt passes information between the parties and is not a party to any relationship or decision between them. Any decision you make in reliance on a profile or document, including whether to engage a business, grant access, or enter a contract, is made at your own risk and judgment. We do not guarantee that a business is adequately insured, licensed, or suitable, and we are not liable for any loss arising from your reliance on information displayed through the Service.
8. Accuracy of Information
The information on a profile depends on what the business provides. We do not independently guarantee the accuracy, authenticity, or completeness of documents beyond the specific check described on the profile. You rely on any profile at your own discretion.
9. Indemnification
You agree to indemnify and hold harmless CavaIt Inc. and its officers, directors, and employees from any claim, demand, loss, or expense, including reasonable legal fees, arising from documents or information you upload, your breach of these Terms, your violation of any law, or your infringement of the rights of any third party, including where you upload a document or personal information you had no right to share.
10. Intellectual Property
All content, features, and functionality of the Service, including the platform, verification logic, user interface design, and branding, are owned by CavaIt Inc. and protected by Canadian and international intellectual property laws. You retain ownership of the documents and information you upload, and you grant us a licence to host, display, and share them as needed to operate the Service at your direction.
11. Fees
Some features are free and others are paid, as described at the point of use. Paid subscriptions renew and can be cancelled as set out in your account settings and the pricing page.
12. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we reasonably believe your use poses a risk to the Service or to others. On termination, your public link stops working and we handle your data as described in the Privacy Policy. Sections that by their nature should survive termination, including those on responsibility, disclaimers, limitation of liability, and indemnification, will survive.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information displayed is accurate, current, or genuine, except as expressly stated for a specific verification feature.
14. Limitation of Liability
To the maximum extent permitted by law, CavaIt Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or goodwill, arising from your use of the Service or from any reliance on information displayed through it, including where a document turns out to be inaccurate, forged, expired, or misrepresented.
15. Modifications
We may modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use after changes constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
